Investor-State Dispute Settlement (ISDS) is a provision in Bilateral Investment Treaties (BITs) and other international investment agreements that allows investors to enter arbitration with states over treaty breaches. ISDS has become controversial in the United States and our negotiating partners; critics, including some governments, have argued that ISDS is unnecessary, while others insist it is illegitimate as public policy. Treaty-based investment protection represents a major advance in the fair treatment of aliens and the peaceful resolution of disputes. Given the alternatives, withdrawing from investment treaties—the logical conclusion of the critics’ position—would likely have negative consequences for economic growth and the rule of law. This report is an empirical review of ISDS, based on the record of disputes under existing investment treaties.

Equal rights between men and women are enshrined as a fundamental human right in the UN Charter, and reflected in various internationally agreed instruments, such as the 1979 Convention on the Elimination of All Forms of Discrimination against Women and the 1995 Beijing Declaration and Platform for Action. Although there has been notable progress in some areas, in most nations women are still at a disadvantage in terms of their role and position in the economic and political arenas. This publication examines the gender dimension of trade and seeks to identify policy challenges and responses to promote gender equality in light of increasing globalisation. Issues discussed include: economics of gender equality, international trade and development; multilateral negotiations on agriculture in developing countries; gender-related issues in the textiles and clothing sectors; international trade in services; gender and the TRIPS Agreement; the impact of WTO rules on gender equality; human rights aspects; fair trade initiatives; the role of IT in promoting gender equality, the Gender Trade Impact Assessment and trade reform.

The number of international investment agreements (IIAs) continues to grow as the use of foreign direct investment (FDI) flows has become a key part of our globalised economy, with for example, almost two bilateral investment treaties added every week during 2004. This publication is the first of a three volume compilation of papers to aid negotiators and policy-makers, in particular from developing countries, with issues arising in discussions of IIAs. This volume contains 12 chapters which cover a range of issues including: an overview of key trends; scope and definition; admission and establishment; most-favoured nation treatment; fair and equitable treatment; taking of property; transfer of funds; transparency; and dispute settlement.
