Jackson, defendant, appealed against a conviction of manslaughter, mounting his appeal on a bill of exceptions that included the exclusion of evidence pertaining to the quarrelsome and vicious nature of the victim and a previous quarrel between the victim and the defendant, an objection to his not having been presented with a list of the jurors and a copy of the indictment against him two full days before the trial, and an objection to the characters of the jurors. The Supreme Court affirmed judgment, acknowledging that the objections had not been raised either prior to or during the trial.

The central focus of the book is on the different approaches that courts can use to lessen the impact of implicit bias by "breaking the bias habit."
