This Brief aims at providing a general understanding of the rationale – scientific as well as political – behind EU policy and related risk management decisions in the area on non-animal food imports. Lately, various menaces associated with imported food and feed of non-animal origin appeared in the media: imported sprout seeds contaminated with E. coli, strawberries containing hepatitis A or noro viruses, to name but a few, are now as much discussed as the different well-known meat scandals. The authors explain the reinforced official controls at EU borders on certain imports of non-animal origin and the wide range of EU measures that currently foresee trade restrictions for imports presenting chemical and non-chemical ‘high risks’ from a public health perspective (so-called ‘emergency measures’). The Brief closely examines chemical (and also non-chemical) risks associated with imports of non-animal origin and their impact on human health. The authors also consider the role risk analysis is playing to underpin risk-management decisions at EU level, including the scientific output by the European Food Safety Authority (EFSA).

This Brief discusses aspects of the increasingly complex production of legal and reliable food products of non-animal origin. It introduces to the Food Safety Modernization Act (FSMA) in the USA (from January 2011), which requires the food industry to follow risk-based approaches with stronger self-regulation of food safety through measures such as the foreign supplier verification programs (FSVPs). This Report provides an overview of the results of increased official import controls carried out by Member States of the European Union (EUMSs) on certain food and feed of non-animal origin from certain third countries, in accordance with Commission Implementing Regulation (EC) No 669/2009 from 25 January 2010 until it was repealed by Commission Implementing Regulation (EU) 2019/1793 with effect from 14 December 2019. Food and feed subject to an increased level of official controls upon their entry into the EU were listed in Annex I to the Regulation. Controlled hazards comprised pesticide residues, mycotoxins, pathogenic microorganisms, and other hazards including contaminants, such as heavy metals, and additives. This Annex was reviewed periodically - on 31 occasions - by the European Commission (EC) to react swiftly to new available information, such as the outcome of identity and physical checks, including laboratory analysis, submitted by the EUMSs. 55 product groups/products within a product group, were de-listed by the Commission mainly due to action taken by third countries; and 71 new products/product groups were listed. For the majority of de-listed products, the control regime went back to the pre-listing situation (risk-based controls and no harmonised frequency at EU level). For one product, emergency measures were put in place. For 19 products/product groups, the frequency of checks was reduced, while it was incremented for 21 products/product groups. Between 2010 and 2019, around 924.000 consignments of listed feed and food of non-animal origin were presented at EU borders. Over 117.700 were sampled for laboratory analysis, of which 6334 were found in breach of EU legislation and prevented from entering the EU market. 88.401 laboratory analysis were carried out on 721.140 consignments of commodities such as peppers, tea, beans and peas and other vegetables and fruits, listed for the contamination risk of pesticide residues, corresponding to 78% of the total number of consignments of listed food and feed having reached EU borders between 2010 and 2019, and 75% of the total number of laboratory analysis performed by EUMSs. The non-compliance rate of 4,8% found is the third highest. 15.165 laboratory analysis were carried out on 105.821 consignments of commodities such as groundnuts, hazelnuts, pistachios, dried spices, dried grapes and dried vine fruits listed for the contamination risk of aflatoxins, corresponding to 13% of the checked consignments. The non-compliance rate of 7,4% is the second highest. The highest non-compliance rate of nearly 10% was reported for pathogenic microorganisms such as Salmonella and norovirus, for which a limited number of commodities are listed, including herbs and spices, and as of 2014 and 2017, betel leaves and Sesamum seeds respectively. 44.599 consignments, corresponding to less than 5% of the total number of consignments of listed food and feed, were presented at EU borders and were subject to 6.465 laboratory analysis. Finally, 7734 laboratory analysis were carried out on commodities listed for other hazards, corresponding to 5,7% of the total number of consignments, with a non-compliance rate of 3,8%. The new set of harmonised rules on import controls of food and feed of non-animal origin set in Regulation (EU) 2017/625 and Regulation (EU) 2019/1793 allow for simplification and modernisation of the European Union legal framework. The latter consolidates legal acts concerning reinforced controls and emergency measures establishing special import conditions and suspension of imports of food and feed from certain third countries. The lists of food and feed concerned are established and regularly reviewed on the basis of a known or emerging risk or because there is evidence of widespread serious non-compliance with the Union agrifood chain legislation.

Ensuring that European food imports are safe presents special challenges, as production takes place in third countries outside the direct control of the member states. Yet, contrary to conventional wisdom, besides a few exceptions regarding high-risk products (such as animals and animal products), the regulation of food import safety in the European Union (EU) is not the focus of direct legislative attention. As a result, the safety of food imports in Europe is pursued not through the application of special conditions governing the import of third-country products, which would impose systematic and Herculean checks at the external borders, but rather through the decentralised enforcement by member states' market surveillance authorities of a harmonised set of product safety regulations: the European food safety acquis. This article provides a critical analysis of this regime by choosing as a case study the recent melamine dairy scandal. Although representing one of the most challenging food contaminations the world has ever faced, the melamine dairy scandal did not produce any tangible negative health effects on the European population. By examining in detail the main features and mechanisms of the EU food safety regime, with a particular focus on the rapid alert system (RASFF), this article assesses to what extent this outcome can be ascribed to the European regulatory framework or to other factors.

This FAO manual on Risk based imported food control aims to support competent authorities in improving the effectiveness of the control measures they are overseeing, based on an analysis of their specific country situation. While BSE has not been found in the United States, federal actions do not sufficiently ensure that all BSE-infected animals or products are kept out or that if BSE were found, it would be detected promptly and not spread to other cattle through animal feed or enter the human food supply. With regard to imports, the United States had imported about 125 million pounds of beef (0.35 percent of total imported) and about 1,000 cattle (0.003 percent of total imported) from countries that later discovered BSE during the period when BSE would have been incubating. In addition, weaknesses in USDA's and FDA's import controls, such as inspection capacity that has not kept pace with the growth in imports, may allow BSE-infected products to enter the country. With regard to animal testing to detect BSE, although USDA has steadily increased the number of animals it tests, it does not include many animals that die on farms. Experts consider these animals a high-risk population. Concerning the feed ban, FDA has not acted promptly to compel firms to keep prohibited proteins out of cattle feed and to label animal feed that cannot be fed to cattle. We identified some noncompliant firms that had not been reinspected for 2 or more years and instances when no enforcement action had occurred even though the firms had been found noncompliant on multiple inspections. Moreover, FDA s data on inspections are severely flawed and, as a result, FDA does not know the full extent of industry compliance. FDA acknowledges that it has not yet identified and inspected all firms subject to the ban. In terms of the public health risk, consumers do not always know when foods and other products they use may contain central nervous system tissue, which, according to scientific experts, could pose a health risk if taken from diseased animals.
