Excerpt from State and Municipal Government in the United States In spite of the importance and interest of international and national questions of policy and in spite of the rapidly widening sphere of federal legislation and administration the life of an American citizen is affected more often by the agencies of local government than by those of the national government. Under the protection of the Federal Constitution the life and property of the citizen are governed and protected by state, not federal, laws. In his political capacity the citizen takes part in both the federal and the local government in accordance with state regulations. Acting under the state laws are the particular political units in which the citizen may reside - the county, city, or town. T o the authorities of these the citizen most fre quently looks for governmental support and regulation. Yet these local bodies are distinctly subordinate to and created by the authority of the state and are supervised and regulated by it. It is the purpose of this book to discuss the organization, the distribution of powers and functions, and the operation of these agencies of local government. Other books have dealt with state government and state administration or with munici pal government and municipal administration, but this book covers both state and municipal government, treating the two as a single manifestation of local government. With this in mind the book has been divided into five parts. In Part I the federal system and the state constitutions as the fundamental basis of local government are discussed. Part 11 deals with the political system - the electorate in theory and in action, in primaries, in election campaigns, and in its direct action in the use of the initiative, referendum, and recall. Part III deals with state government - the different organs and the functions which these organs perform. State administration, which is rapidly being extended both directly and through the supervisory power of the state, is discussed in its various manifestations. Excerpt from The Government of Hudson County, New Jersey In certain aspects, state centralization of control over counties has been developed, to a more advanced stage in New Jersey than in the majority of states.22 However, the two counter tendencies, first, of centralized control over local afiairs by the state, and second of greater self government by the local county and municipal authori ties, are discernible in this State as elsewhere. The con stitutional provision requiring equal representation of all counties in the senate has assisted the centralization ists in state control over the larger counties; the larger counties have beenat the mercy of the smaller. The leg islatures have frequently enacted legislation affecting the internal government of the large counties which the latter claimed should be a matter for their own regula tion. The fact that Hudson County has always been a stronghold for one political party, while the legislature for twenty years has been under the control of the rival party, has increased the antagonism between the state and county governments. In various writings on German life and institutions, now covering a period of just twenty-five years, I have touched upon isolated aspects of the subject of municipal government. Now, for the first time, I have the satisfaction of dealing with the subject systematically, and so of giving to it, as I trust, a treatment worthier of its importance. The actual work of writing has been spread over four years. The book, as its title explains, is concerned solely with questions of urban administration, yet without the limitation which the use of the word "municipal" might seem to suggest. The larger German cities and towns correspond for all practical purposes to the municipalities of the United Kingdom, as the smaller German towns correspond to our urban districts; hence it has appeared to me justifiable to consider convenience rather than strict historical and technical accuracy in the use of the terms "municipality" and "municipal," and to follow common wont in applying these terms to urban organisations, institutions, and activities generally, irrespective of the question of incorporation as understood in this country. On the subject of sources, a special remark needs to be made. This is not a book written from books, though German literature has, of course, been freely used.
