Excerpt from Marriage Legislation in the New Code of Canon Law It comes, too, at an opportune moment. Tragic events of today, the bitter fruit of four centuries of lax thinking among non-catholic schoolmen and proportionately lax living among their disciples, have shown that the ethical order must be refashioned in the ancient Christian pattern if the race of men is to sustain itself even physically, the more so if there is to be real moral advancement. The world will not come back to Christ, nor be made subject to His reign by any influence the world itself may initiate; the impulse must be from without - the force must come from above. The Church of Christ, which is not of this world, must bring from on high the heavenly grace that will heal the nations. Her mis sion is to teach, her remedy for the world's distemper is primarily the imparting of the form of sound words. Excerpt from The New Canon Law: A Commentary and Summary of the New Code of Canon Law For several months past the articles by Father Stanislaus Woywod in the Ecclesiastical Review have informed the clergy of the most important features of the new Code of Canon Law. The same author now gives to the public a Summary and Commentary of the whole Code. As the present volume is published mainly with a view of the needs of the clergy engaged in the care of souls, the bulk of the book has been kept as compact as possible; wherefore in such places only where explanation and comment seemed necessary they have been given, and in as brief a form as possible. Chapters which are not needed by every priest have been mentioned only with few words and en passant, as it were. The fourth and the fifth Book have been summed up very briefly, giving the most important points of legislation contained therein. A very complete Index will make it easy to find any desired point of law. We heartily congratulate Father Woywod on the good work and trust that the clergy of the United States will be pleased to find in this volume a welcome means of acquiring the necessary knowledge of the new legislation of the Church. Excerpt from Current Policies of Roman Catholic Marriage Tribunals The universal conformity to laws. Norms and procedures for which the Catholic Church was well known came into being with the promulgation of the Code of Canon Law in 1917. The laws which govern the procedures of the marriage courts are found in Book IV of the Code of Canon Lay (canons 1552 Although the laws which were promulgated in May of 1917 did not become effective until 19 May 1918. There has been no change in the laws of marriage to this date.3 The procedures of the marriage courts have also been very rigid. The norms were determined by what had taken place in the adjudicition of each marriage case over the centuries. Excerpt from A Commentary on the New Code of Canon Law, Vol. 5: Book III: De Rebus, or Administrative Law; Marriage Law (Can. 1012-1143), Matrimonial Trials (Can. 1960-1992) We have added the canons from Book IV treating of Matrimonial Trials, not with the intention of correct ing the logical order of the Code, but solely for the sake of convenience. This will, we believe, be appreciated especially by those who have to occupy themselves fre quently with matrimonial matters, we mean the diocesan court officials. A word concerning the sources. The reader may per haps be surprised at not finding a large array of secondary sources, i.e., authors cited. There were two reasons which prompted moderation in this respect. The first is that we have given prominence to the primary sources as quoted by Cardinal Gasparri, which we have consulted and made discreet use of. The other reason is a practical one. The English reader does not care to cast his eyes to the bottom of the page for every assertion in the text, and we did not deem it proper to swell the bulk of the book with endless quotations.
