On 26 November 2015 the Home Secretary announced, by means of a Written Ministerial Statement, the Government's intention to invite both Houses of Parliament to agree that the United Kingdom should rejoin the Prèm Decisions. These are two Council Decisions1 under which the police forces of EU Member States are able automatically to share DNA, fingerprint and vehicle registration data. The Government has also invited the two Houses to agree that the United Kingdom rejoin the Framework Decision on the accreditation of forensic service laboratories, 2 which recognises the validity of DNA and fingerprint analyses from other Member States and is necessary for participation in the Prèm Decisions. Although at the time of writing a motion had not been tabled, the Committee understanding is that there will be a debate in the House of Commons on 8 December, and in the House of Lords on 9 December. The purpose of this Report, is to assist the House, both by presenting the background to the debate in a more succinct and accessible format than the Government has provided, and by putting on the record the view of the European Union Committee on why the UK should rejoin the Prèm Decisions. It is clear to the Committe that the major benefit of fully implementing Prèm is that the initial automated exchange of data relating to criminal investigation, enabling targeted follow-up action, would solve more crimes more quickly, would identify international criminals and volume crime more effectively, and would build up intelligence relevant to the investigation of very serious crime, including terrorism. The recent increase in the level of the terrorist threat underlines the critical importance of realising these benefits, in order to protect the people of the United Kingdom more effectively.

Missing Trader Intra-Community Fraud (also known as carousel fraud), where goods are repeatedly exported and imported with the EU, has caused a considerable loss of revenue In 2005/6 it is estimated the UK lost between £3-4.5 billion. This report looks both at some of the measure that have been taken to recoup some of this money and measures to stop fraud occurring. In addition it considers whether the Government's policies have imposed an unreasonable burden upon legitimate businesses within affected sectors. It concludes that not only are existing measures unsustainable, steps need to be taken to ensure innocent traders are not damaged. The government needs to work with Member States to implement a system of taxation of intra-Community transactions that will be less vulnerable to major fraud.

In 2013, twenty-five Member States of the European Union decided to take European patenting and patent enforcement to a next level. They agreed on a common patent title and a common patent court, i.e. the new Unitary Patent and the Unified Patent Court. Unfortunately, the implementation phase of the new patent package appeared to be a bumpy ride: non-participating Member States attacked the legal texts before the EU Court of Justice, the Rules of Procedure of the Unified Patent Court were subject to extensive debates, the Brexit caused the UK to step out of the system, an action before the constitutional court in Germany resulted in years of delay, etc. Nevertheless, the unitary patent package appeared to be a survivor. On 1 June 2023, the Unified Patent Court could finally open its doors with seventeen EU participating Member States. At the same time the first Unitary Patents could officially be registered. From then on, companies, research institutions, and individuals are able to obtain not only a patent title with immediate effect in the participating EU Member States, but also a court decision on infringement or validity of a European or Unitary Patent with immediate effect in all the participating Member States. The authors of this book, one being a leading Belgian IP lawyer who had a hand in the legal texts of the Unitary Patent and the other being a reputed Belgian intellectual property appeal judge who is currently (part-time) UPC judge at the local division in Brussels, were the first in 2013 to publish an introduction to the Unitary Patent and the Unified Patent Court.
