Excerpt from Digest of the Laws of Virginia of a Criminal Nature No apology is needed, to the profession, for presenting them with a second edition of this Digest. The first edition made its appearance just before the commencement of the late civil war, when the demand for legal publications was very limited. Inter arma silent leges. At the close of hostilities, so much of the first edition as remained on hand was destroyed by the great conflagration in Richmond city, to wit, in April, 1865. Since that time the greater part of the criminal statutes have been amended and re-enacted, new statutes passed, and several volumes of decisions of the Supreme Court of Appeals have been published. Other changes have been made necessary by the new State Constitution, prefixed to the work. While this edition was passing through the press, and just after the last chapter had been printed, the Acts of 1870-1871 were published, making further changes in the criminal law, particularly in the chapters on "Trial and its Incidents," and the "Penitentiary;" and a law has been enacted enlarging the jurisdiction of Justices of the Peace. These may be found in the Addenda, at the end of the work. The subjects in this, as in the first edition, were alphabetically arranged, but through inadvertence of the printers, this arrangement has been partially altered. The alteration was not detected in time to have it corrected. Some valuable forms for clerks of courts in swearing and charging juries may be found incorporated with the notes, in their appropriate places.
