Excerpt from A History of Divorce So far as I am aware, there is no book in the English language which gives a concise and simple account of the history of divorce, and there is no modem problem in which the historical and comparative study of law and opinion is so essential for those who administer or make the laws, and all those who wish to have an adequate knowledge of the subject in its modem bearings. The extraordinary diversity of laws and opinions which exists in modem countries of the same degree of civilisation, often professing the same religion, when seen in the light of history is found to have certain common elements which show that substantially the same forces have been at work in their evolution. The object of this book is to explain, as briefly and simply as I can, how this diversity came about, to endeavour to deduce from the facts of history the tendencies of thought and legislation, and to ascertain the principles which, according to the teaching of history, ought to be applied to modern legislation on the subject. Excerpt from A Popular Treatise on the Law of Marriage and Divorce To those who have patronized these divorce sharks, and to those who may be tempted so to do, this little book is dedicated. A careful peru sal of its contents may enable them to protect themselves against fraud, and possibly save some of them from the penitentiary. There is but one road over which one must travel to undo a marriage, and this is through the channels of the local courts, where one, at least, of the parties permanently resides and has his or her domicile. A divorce obtained otherwise, though red-taped, red-lined, and bearing a golden seal, is but as waste paper, and no protection whatever at any time or place. Excerpt from The History of Marriage, Jewish and Christian, in Relation to Divorce and Certain Forbidden Degrees I hope I may be excused for this long personal explanation, which I have given simply to show that I have not voluntarily chosen the subject Indeed it has at times been a painful task, and all along a most distasteful one. It can never be pleasant to have to put aside attractive work, and give oneself up to a consideration of such subjects as a treatise on the history of marriage, in especial reference to its perversions, necessarily entails; but it may be a duty. I can only hope that what I have written touching the testimony of primitive antiquity, and also on the present experience of the evil results of relaxing the Marriage Laws in different countries, may have some little in uence upon public Opinion, in making men regret the concessions which the British Legislature made in 1857, and in deter mining them not to let the principle of relaxa tion proceed a single step further. Excerpt from The Marriage Revolt a Study of Marriage and Divorce HE two passages quoted above serve to indicate the motive and scope of this book. Its Object, in the first place, is to present the facts and Opinions that have led to what appears to be a Widespread revolt against conventional marriage and an equally widespread increase of divorce; next, to discover to what extent any definite new conceptions, emerging from this conflict, are finding acceptance; and, lastly, from an examination and analysis of causes and effects to obtain a forecast of probable future results.
